Practice Description

Brendan S. Lowrey focuses his practice on permitting, compliance counseling, and administrative and judicial litigation in environmental matters before local, state, and federal environmental agencies and state and federal courts. He represents clients in various industry and commercial sectors, including construction, steel, recycling operations, petroleum refining, organic chemicals, oil and gas exploration and production, transportation, medical, and real estate development.

In addition, Mr. Lowrey represents clients in matters related to federal, state, and municipal storm water programs, in state and federal Superfund actions involving liability and allocation issues and representation of property owners seeking cost recovery under Texas law, and in federal EPA and OSHA investigations and enforcement actions. He also advises clients regarding spill and release notification and emergency response issues; environmental conditions affecting real property, the Texas Innocent Owner/Operator Program, application of the Texas Risk Reduction Rules, and utilization of Municipal Setting Designations; the investigation, remediation, and disposal of mold and asbestos; TSCA and RCRA inspections and enforcement; and waste issues, including storage and disposal of medical waste.

  • Representing multiple clients in obtaining regulatory closure for contaminated properties

  • Representing national commercial builder in administrative enforcement actions brought by federal OSHA, state solid waste agency, and state air quality bureau arising out of handling of asbestos containing material

  • Defending oil and gas company in litigation related to presence of asbestos cement water lines on lease properties

  • Representing major homebuilder in responding to administrative and judicial storm water enforcement actions at the federal, state, and local level
