Practice Description

Deborah L. Lively focuses her practice on intellectual property, sweepstakes, and privacy law. She advises clients on intellectual property transactions including domestic and international trademark prosecution and enforcement, copyright registration and compliance, intellectual property assignments and licenses, and software support agreements. Ms. Lively also counsels clients on sweepstakes promotions and on compliance with such privacy laws as the Children's Online Privacy Protection Act ("COPPA"), the Telephone Consumer Protection Act, and the CAN-SPAM Act.

• Counseled retail businesses regarding the management and prosecution of trademarks in large trademark portfolios

• Reviewed and prepared official rules for sweepstakes promotions held by numerous companies and organizations

• Prepared intellectual property license agreements for numerous clients

• Represented domain name registrants in ICANN domain name disputes

• Provided copyright advice and assisted software companies in the copyright enforcement of software license agreements
