Becky Jolin focuses her practice on environmental issues affecting industry, with special emphasis on permitting, compliance, rule-making, liability management, and administrative, civil, and criminal enforcement regarding air emissions, water discharges, solid and hazardous waste management, and PCBs, radioactive materials, and other toxic and hazardous substances. She represents clients before federal, state, and local agencies, and also defends clients in state and federal administrative, civil, and criminal enforcement actions.

Becky represents clients in various industrial sectors, including steel, oil and gas, chemical, semiconductor, pharmaceutical, health care, cement, and lime manufacturing.

Becky also has extensive experience in managing environmental risks through designing and conducting environmental, health, and safety diligence and environmental audits; preparing environmental disclosures; and drafting environmental liability provisions for business transactions.

Experience

  • Advised manufacturing and health care clients regarding complex air compliance issues, including new source review permitting, federal operating permitting, and MACT compliance

  • Advised clients regarding EPA and state investigations and requests for information under the Clean Air Act, Clean Water Act, Resource Conservation and Recovery Act, and Toxic Substances Control Act

  • Defended major manufacturing facilities in federal and state administrative enforcement actions under the Resource Conservation and Recovery Act and the Clean Air Act

  • Conducted audits under state audit privilege acts and the EPA Audit Policy, prepared disclosures, and counseled corrective action regarding air, waste, water discharge, drinking water, EPCRA, PCB, and SPCC regulations for chemical, steel, cement, lime manufacturing, mining, and health care facilities

  • Designed and managed the environmental due diligence for the acquisition of industrial facilities, including two petroleum refineries, a paper mill, multiple pharmaceutical manufacturing plants, semiconductor plants, shale oil operations, outer continental shelf oil and gas operations, and natural gas operations from the wellhead to the customer

  • Represented chemical manufacturer in judicial action asserting that letter issued by EPA's TSCA program was a rule that was promulgated in violation of the notice and comment provisions of the Administrative Procedure Act

  • Defended major oil company in action by USEPA asserting multiple oil and gas production facilities were a single major source subject to the Title V and New Source Review permit requirements of the Clean Air Act

  • Defended a major manufacturing facility in a Clean Air Act citizens' suit
