Representation of clients before administrative agencies and the courts is a significant portion of Thompson & Knight's environmental law practice. Such litigation includes administrative or judicial review of agency action, agency enforcement proceedings, and state and federal Superfund actions. Our environmental attorneys have served as lead counsel for individual clients, as well as common counsel for client groups.
One example of our common counsel experience is the Hardage Criner Superfund Site in Oklahoma, in which Thompson & Knight was common counsel for all defendants for both remedy and geology. We were also common counsel in the Odessa Chrome Site in Odessa, Texas, where we defeated the EPA's position that joint and several liability should be imposed and also established the law in the Fifth Circuit on apportionment of liability in Superfund cases. Thompson & Knight also served as common counsel for the Texas steel mill industry group's effort to obtain a co-product designation for steel slag.
