Katie Clark represents clients before bankruptcy courts, federal and state trial courts, arbitration panels, and appellate courts. She focuses her practice on all aspects of bankruptcy and insolvency litigation, including representation of banks, indenture trustees, acquirers of assets from bankruptcy estates, court-appointed fiduciaries, and debtors and creditors in Chapter 11, 7, and 13 bankruptcy cases. She has particular experience in the intersection of real estate matters and bankruptcy, and routinely represents investment banks, commercial banks, and other lenders who originate commercial mortgage loans including CMBS matters.

Katie also has experience in counseling on state and federal matters involving general commercial litigation. Additionally, her practice includes representing court-appointed receivers in civil litigation matters. Katie is further committed to including pro bono work and community involvement in her practice.

Bankruptcy and Creditors' Rights

  • Served as counsel to Thomas Moran, the Chapter 11 trustee for Life Partners, a life settlement company with greater than $1.4 billion in liabilities. Life Partners Holdings, Inc. received the 2017 Turnaround Atlas award for “Chapter 11 Restructuring of the Year” in the U.S. and the 2017 Turnaround Management Association Turnaround and Transaction of the Year Award for “Turnaround of the Year: Large Company”
  • Represented Cano Petroleum Inc. and its affiliates, a public company upstream debtor, which obtained confirmation of a pre-negotiated Chapter 11 plan in four months
  • Represented debtor Vitro, S.A.B. de C.V, a Mexican glass manufacturer, in a crossborder restructuring of greater than $2 billion in liabilities

  • Represented financial institution as creditor in In re Hill Country Galleria, L.P., Case No. 09-11175, in the U.S. Bankruptcy Court, Western District of Texas, Austin Division

  • Represented numerous tenant-in-common (TIC) clients in In re DBSI Inc., Case No. 08-12687, in the U.S. Bankruptcy Court, District of Delaware, Wilmington Division

State and Federal Litigation

  • Represented court-appointed receiver in a securities fraud civil action in the U.S. District Court, Northern District of Texas, Dallas Division

  • Represented client in appeal of an award of fraud and damages for fraud resulting in a reversal of the award

  • Represented life insurance company in claim for breach of contract and breach of alleged fiduciary duties

Pro Bono

  • Represented nonprofit organization as a creditor in bankruptcy in defense of its claims against the debtor

  • Helped to organize and implement plan to bring a legal clinic to a previously underserved area of North Texas
