Marc Klein represents employers in all aspects of employment and labor and employment-based immigration law. His employment and labor practice focuses on counseling clients on day-to-day personnel matters, handling administrative proceedings and investigations before federal and state governmental agencies, and representing management in employment litigation, including claims for discrimination and wrongful discharge. Marc also advises management on such corporate immigration matters as the preparation of nonimmigrant and immigrant employment-based visa petitions for foreign national employees and compliance with federal immigration laws. In addition, he represents foreign investors who seek U.S. permanent resident status.

Marc is Board Certified in Labor and Employment Law by the Texas Board of Legal Specialization.


  • Assisted an Italian architectural restoration and conservation firm with establishing a treaty-investor E-2 strategy under which essential-skills technicians obtained authorization to work on a specialized concrete project at a preeminent art museum

  • Obtained affirmance of summary judgment from the Fifth Circuit in a FMLA-retaliation and breach-of-contract case

  • Represented the U.S. subsidiary of a publicly-traded Mexican corporation against claims by its former president for breach of contract and wrongful discharge

  • Obtained summary judgment for an employee-staffing company in a federal action alleging sexual harassment and retaliation

  • Defended a restaurant franchisee with over 20 locations during an independent investigation of employment-eligibility-verification practices by the U.S. Department of Justice Office of Special Counsel for Immigration-Related Unfair Employment Practices

  • Assisted clients in responding to notices of audit and challenging notices of intent to fine from Immigration and Customs Enforcement

  • Formulated and implemented a treaty-trader E-1 visa-application strategy for a large Mexican beer manufacturer to enable the transfer of marketing and promotions personnel to the United States

  • Obtained approval of an extraordinary-ability O-1 nonimmigrant visa petition for a conductor of a world-renowned symphony orchestra

  • Represented foreign nationals in acquiring lawful permanent resident status through investment in a Regional Center (EB-5)
