Michael McMillin focuses his practice on regulatory and administrative law as well as civil litigation. His practice emphasizes state and federal energy regulations, energy markets, energy litigation, and government affairs. As part of that practice, he has litigated many cases in front of the Public Utility Commission of Texas (PUCT), has represented the interests of industrial consumers in the Electric Reliability Council of Texas (ERCOT) stakeholder process, and has worked with clients to provide practical solutions for managing a wide range of issues related to their electricity consumption. He also regularly represents clients in state and federal court litigation matters, including appellate matters in front of the Texas Supreme Court.

Experience

  • Served as second chair in case defending an equipment company in multi-defendant litigation brought by plaintiff oil field services company alleging misappropriation of trade secrets, unfair competition, unjust enrichment, interference with existing and potential contracts, and conspiracy
  • Advised construction companies on compliance issues, including procurement, prevailing wage rates, and historically underutilized business programs
  • Assists clients regarding public utility issues, such as the creation of a chilled water district and grants of nondiscriminatory building access to telecom providers
  • Litigated the proposed acquisition of a $17 billion transmission and distribution utility in front of the PUCT on behalf of a trade association made up of large industrial energy consumers
  • Litigated in favor of granting a certificate of convenience and necessity to a critical transmission line needed to import power into the north end of Houston
  • Litigated multiple base rate cases, cost recovery factor cases, and transmission line routing cases in front of the PUCT
  • Submitted briefs on the merits to the Texas Supreme Court regarding the appeal of a utility rate case
  • Submitted public comments and engaged in oral advocacy regarding a wide range of rulemaking and protocol revision proposals pending in front of the PUCT and ERCOT
  • Represented a large Texas municipality in a protracted legal battle surrounding hundreds of public information requests submitted by a former employee
