Client Alert: City of Los Angeles Adopts New Rule Prohibiting Criminal Inquiries During Application Process

On December 13, 2016 the City of Los Angeles adopted a sweeping new ordinance, Number 184652, that significantly restricts an employer’s ability to inquire about an individual’s criminal convictions or other criminal history during the employment application process.  This ordinance is similar to ordinances adopted in New York, Austin, Portland, and San Francisco, but may go even further than those ordinances.  Employers with employees or operations in Los Angeles should be mindful of its requirements as the ordinance goes into effect on January 22, 2017 (although there is a grace period until July 1, 2017 during which only warnings, rather than administrative fines, will be issued by the City).
