Client Alert: The Federal Defend Trade Secrets Act

President Obama is expected to sign into law the Defend Trade Secrets Act of 2016 (“DTSA”), passed by Congress last week, marking a significant expansion of federal law to protect trade secrets. The DTSA amends the Economic Espionage Act of 1996,  which currently provides only criminal sanctions for trade-secret misappropriation. It gives federal courts jurisdiction to hear civil trade-secret misappropriation claims. The DTSA, when enacted, will create federal question jurisdiction for trade-secret misappropriation claims and a single body of federal trade-secret law, applicable nationwide.
