Craig Carpenter Quoted on Effects of Wyndham Decision for Payment Providers

Craig Carpenter was quoted in a Bloomberg BNA article discussing the effects Wyndham Hotels & Resorts LLC’s appeal of a FTC complaint regarding data security practice might have on the financial services and banking industry. As previously discussed on the T&K CyberSecurity Blog, the latest Third Circuit ruling clears the way for the FTC to hold companies accountable for failures in data security policies and practices, but does not do much to help companies identify how to avoid FTC scrutiny (here). In the Bloomberg BNA article, Craig further notes that “in the ever-changing cybersecurity world, it will be difficult to lay out specific requirements.” According to Craig, “It would be difficult to develop and implement a ‘standard’ for data security that has any more specificity than the Court’s analysis in this opinion.” He continues, “The opinion shows that the Court is comfortable” with using the definition of an unfair practice “as an appropriate measuring stick for security standards.” To read the full article, click here.
