Although the ruling is focused entirely on a procedural matter, the underlying action is one that increasingly is being brought by patients, Andrew Cookingham, of Thompson & Knight LLP in Dallas, told Bloomberg BNA.

“This is becoming increasingly common,” Cookingham said. Usually, these types of cases are brought by patients who were injured in car accidents or other torts who either don’t have health insurance or have health insurance but were treated by an out-of-network provider—that is, by a provider who doesn’t have a contract with the patient’s health insurer.
