“Highland Wins Chance To Argue Barclays Docs Are Privileged”

The Second Circuit on Tuesday largely rejected Highland Capital Management LP’s bid to block demands by the IRS for information about its taxes from Barclays Bank PLC regarding the $21 billion investment adviser’s $220 million litigation settlement with the bank, but the court gave Highland a chance to argue privilege.

Highland attorney William M. Katz Jr. of Thompson & Knight LLP told the panel that there may exist a “common interest privilege” between his client and Barclays, reminding the judges that their relationship only became “acrimonious” in recent years.
