“BNSF Wants New Trial Set In Worker Retaliation Case”

BNSF Railway Co. asked a Missouri federal judge Monday to set a new trial in a railroad worker’s retaliation suit claiming he was disciplined for not immediately reporting an on-the-job eye injury, saying the worker is dragging his heels after the Eighth Circuit recently ruled against him.

The railroad giant asked the district court to deny Edward Blackorby’s request to stay proceedings until he figures out whether he’ll petition the U.S. Supreme Court to hear his retaliation case after the Eighth Circuit refused to rehear a three-judge panel’s February decision reversing the $58,280 jury verdict Blackorby had won in 2015.
