Obesity is not a covered condition of the Americans with Disabilities Act, the Eighth Circuit ruled on Tuesday, saying that BNSF Railway Co. was within its rights to deny employment to an otherwise qualified obese job applicant because his weight was not the result of another physiological impairment.
