“Texas Justices Told Heineken Stake Shouldn’t Stop Permit”

A Texas subsidiary of Mexican convenience store giant OXXO told the Texas Supreme Court in oral arguments Monday that the state’s alcoholic beverage commission unfairly denied it a liquor permit based on the faulty application of cross-ownership rules.

Debora Alsup, arguing on behalf of Cadena Commercial USA Corp, which operates as OXXO, told the court that the Texas Alcoholic Beverage Commission had been unreasonable in its interpretation of the statute because it ignored corporate separateness, and had essentially given itself “unbridled power to choose who gets a permit and who doesn’t.”
