Houston, Texas – U.S. District Judge Lynn N. Hughes has entered a final judgment in the amount of $1.2 million plus interest and attorneys’ fees against Houston-based Petroleum Pipe Americas Corporation (“PPA”) after finding that the pipe distributor breached a contract with Jindal SAW Ltd. (“Jindal”), a total pipe solutions company manufacturing Seamless Steel OCTG, Drill Pipes, SAW Pipes, Ductile Iron Pipes, and Anti Corrosion Coatings with headquarters in New Delhi, India.
PPA sued Jindal in May 2007 seeking approximately $2.4 million in damages over pipe sold by Jindal, despite a settlement agreement that had been reached the year before between the two companies. In response, Jindal asserted counterclaims for breach of the settlement agreement, and all claims were heard in a three-day bench trial in February 2011.
On Aug. 22, 2011, the Court entered a take-nothing judgment against PPA and awarded Jindal $1,228,884.42 in damages, plus pre- and post-judgment interest and attorneys’ fees, which will be determined at a subsequent hearing.
“We stand by our product and our contracts, and this outcome validates our commitment to excellence. This is a long- and hard-fought victory, and while we regret that litigation was initiated, we are very pleased with the result,” says Sunil Jagtiani, Vice President of Marketing and Sales at Jindal SAW Ltd.
The case is Petroleum Pipe Americas Corp. v. Jindal SAW, Ltd., Case No. 4:07-cv-02210 in the U.S. District Court for the Southern District of Texas. Partner Hunter M. Barrow at Thompson & Knight LLP in Houston was the lead attorney on the team representing Jindal, which included Partner Debora B. Alsup in the Firm’s Austin office.
