“Yelp Review of Pet-sitting Company Protected by Free-Speech, Defendants Argue”
Nicole Williams, a partner in Dallas’ Thompson & Knight who represents the pet owners on a pro bono basis, said the Yelp.com review was posted by Michelle Duchoquette and she didn’t sign the contract. But even if she had, the clause barring the couple from speaking truthfully would violate free-speech rights, Williams said.
In the big picture, Williams expresses concern generally about such contractual limits to consumers’ rights to post honest reviews on Yelp.com.
“It not only harms consumers that can’t tell what the real reviews are, but it harms businesses that are operating in a more proper manner,” Williams said.
