“Architect Tells Texas High Court To Toss Negligence Suit”

The Texas Supreme Court was told in oral arguments Monday morning that a negligence lawsuit brought against an architecture firm should be dismissed with prejudice because the expert testimony offered in support of the claims doesn’t meet the minimum standards.

Richard Phillips, who represents architecture firm Levinson Alcoser Associates LP, told the Texas Supreme Court on Monday that it must reverse the state’s Fifth Court of Appeals holding that the affidavit filed on behalf of El Pistolon Ltd. was sufficient, otherwise the vague document could conceivably be used in every lawsuit against an architect, simply by changing the name of the firm.
