“Stern challenged over lack of disclosure”
A UK oil and gas company has challenged French arbitrator Brigitte Stern in an ICSID claim against Egypt, alleging she refused to disclose information about her own company and links to Egyptian institutions.
… According to Thompson & Knight partner Andrew Melsheimer, the challenge primarily relates to
Stern’s failure to comply with her duty of disclosure under the ICSID rules. She refused several requests for information and “kept areas secret where she may have potential conflict and financial benefit,” he says.
Melsheimer says Stern failed to disclose relevant information including about her company, “Brigitte Stern”, and her links with the Cairo University and Alexandria Library in Egypt. Petroceltic therefore was “denied the opportunity to assess if she is independent and without bias.”
