HOUSTON – The law firm of Thompson & Knight LLP is pleased to announce the Firm, along with Shell Oil Company’s Kevin Feeney, were named as finalists in the Business Litigation of the Year category at the inaugural Houston Corporate Counsel Awards. The awards ceremony, sponsored by the Houston Chapter of the Association of Corporate Counsel (ACC) and The Texas Lawbook, took place on Thursday, April 25.
Mr. Feeney and Thompson & Knight attorneys Greg Meece, Robert Paddock, and Megan Schmid were selected as finalists for their work on a recent arbitration related to a gas gathering agreement between Shell and a competitor. The two companies were parties to a 10-year Gas Gathering Agreement related to a gathering system connected to wells jointly owned by Shell and the competitor. Upon learning that Shell might not renew the agreement, the claimant calculated the gathering rate for the final two years under the contract at a price that was five times higher than the price of gas. After Shell refused to pay the revised rate, the competitor sued them, seeking in excess of $200 million in damages. After a 17-day arbitration hearing, the panel found, unanimously, no breach by Shell and rendered a take-nothing judgment.
