Conrad Hester focuses his practice on oil and gas litigation. His expertise includes contract disputes, royalty litigation, lease termination and title suits, surface access, and surface damages disputes. Additionally, he has experience drafting and negotiating leases, deeds, and exploration, production, and operational agreements. Conrad also represents clients in a variety of complex commercial litigation matters.

Conrad is Board Certified in Oil, Gas and Mineral Law by the Texas Board of Legal Specialization.

  • Represents clients in lease termination litigation, including total cessation, production in paying quantities, and retained acreage cases at all state levels including the Texas Supreme Court
  • Provides pre-dispute counseling on lease negotiation, acquisition, maintenance, and expiration
  • Represents clients in surface access and damages disputes, including injunctions, easements, salt water disposal, and water rights
  • Handles a variety of royalty disputes for payors and payees, including underpayment, post-production, overriding royalty, executive and non-participating royalty rights, and suspense issues
  • Represented a large Texas-based operator in a series of allocation well cases and counsels clients on allocation formula and production sharing agreement issues
  • Represents clients in mineral and leasehold title litigation
  • Advises clients on mineral deed and lease assignment interpretation and negotiation as well as other title issues, including title defect guidance, bona fide purchaser issues, cotenancy rights, trespass to real property, partition suits, and farmouts
  • Represents operators and non-operators in joint operating agreement litigation and advises on operational compliance
  • Represents companies in a variety of upstream and midstream breach of contract, indemnification, fraud, and related tort cases
