Experience
Justin Cohen focuses his practice on intellectual property litigation and counseling, primarily in the areas of software, electrical, mechanical, telecommunications, and semiconductor technologies. He has represented clients in various patent, copyright, and trademark litigation in a variety of federal district courts, the Court of Appeals for the Federal Circuit, before the Patent Trial and Appeal Board, and in the Trademark Trial and Appeal Board. Justin also helps clients identify, evaluate, license, and enforce their intellectual property assets.
The 2019 edition of the IAM Patent 1000 – The World’s Leading Patent Professionals recognized Justin as “instinctively incisive before a jury.”
In addition to his intellectual property practice, Justin has extensive expertise counseling companies on cybersecurity and data privacy issues. He has assisted companies by performing systematic security audits, investigating security incidents and breaches, assessing and assisting with incident response readiness, and counseling companies on data privacy compliance issues.

Representative Matters
- Represented a patent holder in asserting multiple patents in multiple lawsuits involving various aspects of personal computer power management
- Represented an inventor and holder of standard-essential patents in multiple licensing and litigation matters involving computer networking hardware, including being lead trial counsel in two jury trials, an appeal to the Court of Appeals for the Federal Circuit, and numerous licensing mediations and negotiations
- Defended a leading telecommunications infrastructure-equipment company and a wireless handset manufacturer in a patent infringement lawsuit related to cellular-transmission protocols in the Eastern District of Texas; obtained jury verdict of non-infringement and invalidity of all asserted patent claims
- Defended a semiconductor developer in a Section 337 proceeding in the U.S. International Trade Commission relating to level shifter circuitry
- Defended a major supplier of industrial mining equipment in a patent infringement lawsuit brought by a competitor
- Defended a major airline in numerous patent infringement lawsuits related to secure payment systems, mobile applications, airport kiosks, and encryption algorithms in Federal District Courts in Texas, Delaware, and California
- Represented a major airline in various trademark enforcement matters, including a trademark infringement lawsuit in the Northern District of Texas
- Represented a large nonprofit organization in various trademark enforcement matters, including a trademark infringement lawsuit to enforce its famous marks in the Southern District of Florida
- Defended a wireless handset manufacturer in several patent infringement lawsuits related to LTE, core processor functionality, and user interface features in the Eastern District of Texas
- Defended a large data center in a copyright infringement lawsuit related to software for managing its infrastructure and cloud hosting, co-location, and website hosting services in the Eastern District of Michigan
- Defended a manufacturer of 3D printing/rapid prototyping machines in a patent infringement lawsuit related stereolithography technology in the Eastern District of Michigan
- Represented a client with restaurants in several states in a contested concurrent use proceeding in the Trademark Trial and Appeal Board through trial; obtained opinion from the Board granting the registration
- Drafted and prosecuted patent applications in various arts, including computer hardware, software, telecommunications, electrical, mechanical systems, and business methods for both large and small clients, including a global broadband and telecommunications company and a semiconductor innovator and manufacturer
- Assisted a semiconductor developer in organizing and categorizing a portfolio of more than 5,000 patents and applications for valuation and licensing
