Michael McMillin focuses his practice on regulatory and administrative law as well as civil litigation. His practice emphasizes state and federal energy regulations, energy markets, energy litigation, and government affairs. As part of that practice, he has litigated many cases in front of the Public Utility Commission of Texas (PUCT) the Texas Railroad Commission (RRC), and the New Mexico Public Regulation Commission (NMPRC); has represented the interests of industrial consumers in the Electric Reliability Council of Texas (ERCOT) stakeholder process; and has worked with clients to provide practical solutions for managing a wide range of issues related to their electricity consumption. He also regularly represents clients in state and federal court litigation matters, including appellate matters in front of the Texas Supreme Court.

Representative Matters

  • Regularly represents landowners, developers, and oil and gas operators in electric transmission line routing cases in front of the PUCT
  • Litigated utility sale/transfer/merger proceedings in front of the PUCT related to some of the largest and most complicated utility transactions in state history
  • Regularly litigates utility base rate cases and cost recovery cases in front of the PUCT and NMPRC
  • Litigated a variety of Texas RRC complaint proceedings on behalf of crude oil and natural gas shippers against midstream pipelines
  • Represented the interests of a trade association of industrial consumers in a precedential PUCT proceeding regarding a utility service area dispute between an oil and gas operator and a group of electric cooperatives
  • Litigated a series of rate and cost recovery cases related to a failed several billion dollar coal gasification project in front of the Mississippi Public Service Commission
  • Litigated in favor of granting a certificate of convenience and necessity to a critical transmission line needed to import power into the north end of Houston
  • Submitted briefing to the Texas Supreme Court and Texas Courts of Appeals in a variety of appeals related to PUCT decisions
  • Submitted public comments and engaged in oral advocacy regarding a wide range of rulemaking and protocol revision proposals pending in front of the PUCT and ERCOT
  • Represented a large Texas municipality in a protracted legal battle surrounding hundreds of public information requests submitted by a former employee
