Tony Campiti represents management exclusively in client counseling and litigation. He advises employers on managing employees, workforce training, reductions in force, personnel policies and manuals, employment contracts, covenants not to compete, confidentiality agreements, separation agreements, internal investigations, and compliance with anti-discrimination laws and other employment-related statutes. Tony also advises employers regarding labor-and-employment issues arising in mergers and acquisitions. He regularly represents employers in administrative investigations and proceedings, labor arbitrations, and lawsuits involving covenants not to compete, discrimination, retaliation, harassment, wrongful discharge, breach of contract, wage-and-hour violations, family and medical leave violations, and employee theft and trade secrets issues.

Tony is Board Certified in Labor and Employment Law by the Texas Board of Legal Specialization.

Representative Matters

  • Received summary judgment for a major aeronautics defense contractor in a disability discrimination, national origin, and defamation case
  • Uncovered breach of fiduciary duty in investigation and secured recovery for energy company in breach-of-fiduciary-duty action against the company’s former employees and the assisting-executives and vice principals at another publicly traded company
  • Defended international professional services firm against a declaratory judgment lawsuit in federal court by a senior executive seeking to void his post-employment covenant not to compete and covenant not to solicit clients, including successful avoidance of requested temporary restraining order and preliminary injunction after hearings
  • Obtained summary judgment for national corrugated container manufacturer in a lawsuit claiming disability discrimination, national origin discrimination, workers’ compensation retaliation, and intentional infliction of emotional distress
  • Conducted workplace harassment investigations for local bank, local property management company, and healthcare collection management company
  • Obtained a favorable arbitration award for a global medical device and surgical suture company against a union seeking overtime and related remedies for approximately 1,000 employees
  • Obtained summary judgment for a Fortune 100 computer company in a lawsuit claiming sexual harassment, race discrimination, national origin discrimination, and retaliation; affirmed on appeal
  • Obtained pretrial dismissal for a major aeronautics defense contractor in a lawsuit alleging gender discrimination, sexual harassment, violation of the Gender Motivated Violence Act, and constitutional claims; affirmed on appeal
  • Provided labor and employment advice to a national chain restaurant franchisee in an asset-purchase transaction involving the transfer of over 35 restaurants and more than 2,700 employees
  • Obtained judgment on behalf of a local energy company against a union substantially limiting enforceability of arbitration awards for three employees; affirmed on appeal
  • Obtained summary judgments in workers’ compensation discrimination suits against an online grocery company, a national trucking company, and a large regional law firm
  • Provided onsite labor and employment legal support to a Fortune 100 computer company’s human resources, EEO, and workforce restructuring organizations
  • Obtained dismissal of an unfair labor practice charge filed with the National Labor Relations Board on behalf of a local energy company
  • Obtained summary judgment in a suit alleging that a local oil and gas company failed to pay overtime to field employees in violation of the Fair Labor Standards Act; also obtained summary judgment on claims alleging breach of contract, conversion, and negligence
  • Obtained summary judgment in a suit against a national elevator and escalator company involving workers’ compensation discrimination, unsafe workplace, and retaliatory discharge under the Occupational Safety and Health Act
