Contested Cases

We represent clients in regulatory matters before the PUCT and the Texas Railroad Commission, including rate-making proceedings, planning and implementation of transmission line construction, market-power assessments, tariff proceedings, open-access transmission requirements, and pipeline disputes.

More than 40 years ago, our attorneys tried one of the first contested cases before the Public Utility Commission of Texas (PUCT). Today, our attorneys continue to apply their trial skills to the administrative process.

Thompson & Knight has a “strong record in contesting matters for a range of regional and international companies before entities such as the PUCT, the RRC, and ERCOT.” – Chambers USA 2019

We represent our clients in regulatory matters, including those that involve:

  • Electric utility ratemaking proceedings,
  • Electric transmission development and routing cases,
  • Electric utility mergers and acquisitions,
  • Customer complaints,
  • Market-power litigation,
  • Tariff proceedings,
  • Open-access transmission requirements, and
  • Pipeline disputes.

As trial attorneys, we are skilled at persuading the specialized judges who hear utility cases and at cross-examining expert witnesses on the most complex industry issues. We are involved through every step of the process – from the State Office of Administrative Hearings and the agency, through the District Court and Court of Appeals systems, to the Supreme Court of Texas. For example, the Firm defends on appeal PUCT decisions that we have won for TIEC and other clients.
