We have extensive experience assisting clients in auditing, permitting, compliance, and enforcement issues involving air emissions, including with regard to:

  • Developing the strategy for obtaining permits and exemptions and in preparing and prosecuting applications for permits or other authorizations or approvals;
  • Assisting with New Source Review (NSR) permitting at both the state and federal level and permitting of oil and gas operations using Permits by Rule and Standard Permits for air emissions; and
  • Advising on applicability and compliance related to New Source Performance Standards, National Emission Standards for Hazardous Air Pollutants, and Greenhouse Gas Reporting.

The Firm’s experience also includes working with the Texas Commission on Environmental Quality (TCEQ), the Public Utility Commission of Texas, Groundwater Conservation Districts, and environmental agencies in connection with obtaining needed licenses, permits, amendments, renewals, and other authorizations involving water rights, wastewater facilities, wetlands, storm water facilities, and hazardous waste management and remediation.

  • Assisted Petrohawk Energy Corporation on water rights issues related to fracking operations in Louisiana, including advice on dealing with recently adopted legislative restrictions and negotiations with the state’s attorney general regarding compliance with those restrictions
  • Assisted an E&P company in obtaining after-the-fact permits for fills of wetlands and waters subject to jurisdiction under the Federal Clean Water Act
  • Advised a client regarding permitting of oil and gas operations using Permits by Rule and Standard Permits for air emissions
  • Advised an oil company with respect to expanding the production of an oil refinery
  • Advised a refinery regarding New Source Review issues
