In conjunction with the Firm’s probate attorneys, we represent banks and financial institutions in will contests, suits alleging breach of fiduciary duty, forcing trustee resignation, and trust termination.

We perform an early case assessment on each of our cases to determine the strategy most beneficial to our client, whether it be exploration of early dispute resolution, dispositive motion practice, or trying the case to verdict. During the course of our representation, we assess our client’s procedures to determine whether they can be refined to reduce the risk of litigation and counsel our clients accordingly. Experience

  • Represented a national banking association in defending mortgage fraud cases brought against it in Texas; obtained dismissals of the vast majority of the cases
  • Received a favorable award for our client, a national banking association, in a suit against a Las Vegas show-biz personality who was delinquent in the repayment of a note
  • Represent a trust company as General Counsel, providing legal advice and counseling on all domestic matters
  • Obtained a take-nothing judgment on behalf of a national banking association in federal court alleging malfeasance in a commercial mortgage-backed securitization
  • Represented a national banking association in a suit involving allegations of breach of contract in a deposit agreement
  • Represented a national banking association in a case purporting to force our client to resign as trustee of a trust; received a defense verdict that was affirmed by the court of appeals
  • Obtained a temporary restraining order (TRO) to prevent the disbursement of assets seized as a result of a default judgment taken against our client, a national banking association, without its knowledge; default judgment was ultimately overturned
  • Represented a banking association before the appellate court in a case involving the ability of our client to invoke the arbitration provision in its loan agreement with a customer
  • Represented a national banking association in state court litigation involving allegations of fraudulent transfer and conversion
  • Represented a multi-state bank holding company in shareholder litigation that was concluded by dismissal
