Overview

We regularly advise and represent clients in discrimination and civil rights matters arising outside of the employment context such as Americans with Disabilities Act Title III public-accommodation issues, federal discrimination claims by non-employee physicians, First Amendment free-speech claims, Fair Housing Act claims, and similar claims under state and local laws. We have provided advice to clients to assist with compliance in those areas, and we have represented clients before agencies and in court. Our ADA Title III practice encompasses all aspects of the ADA’s public-accommodation obligations, including physical barriers, auxiliary aids for medical practice and hospital patients, website compliance, and obligations of stadiums and amusement parks.

Experience

  • Obtained summary judgment – and an affirmance on appeal – in a physician peer review lawsuit brought by an African-American cardiologist against a hospital and several physicians and hospital administrators alleging race discrimination, constitutional violations, and multiple common law claims
  • Obtained summary judgment – and an affirmance on appeal – in a high-profile dispute involving First Amendment claims against a private entity operating an amusement park on public property
  • Represented numerous medical practices and hospitals facing ADA Title III claims before the Department of Justice and the Department of Health and Human Services
