View White Collar Criminal Litigation

Thompson & Knight attorneys have a proven and extensive track record in white collar criminal litigation. Our attorneys have represented individuals and business entities in many different forums where criminal issues have been raised, including internal investigations that raise potential criminal exposure, white collar criminal defense, regulatory and administrative proceedings, forfeiture, and grand jury compliance. Our team of former federal (including the former United States Attorney for the Northern District of Texas and a former U.S. independent counsel) and state prosecutors, former DOJ and IRS officials (including the Acting Chief Counsel and Deputy Chief Counsel for the IRS), and seasoned attorneys utilize their comprehensive and extensive trial and advocacy experience in this area of the law in combination with keen analysis, careful preparation, and practical skills to vigorously defend our clients.

The Firm has extensive experience defending federal and state white collar criminal prosecutions and assisting clients in the investigatory stages of potential criminal matters.  Our attorneys have been involved in virtually every aspect of criminal litigation and related civil proceedings and have significant experience in the areas of fraud, financial crimes, tax-related offenses, public corruption, antitrust, false claims, real estate, healthcare, environmental, energy, civil rights, labor relations, insurance, obstruction of justice, conspiracy, trade secrets, securities, and government contracts, among other white collar issues.  We also represent clients involved in “whistle blower” actions against public and other employers, allegations of fraud in domestic and international business transactions, and assist with questions regarding cybersecurity and insurance coverage in these circumstances.  We represent companies and individuals doing business in a variety of industries including telecommunications and technology, healthcare, oil, gas, and energy, engineering, financial services, and transportation, among others.

Internal investigations can be a key aspect of understanding and limiting exposure for white collar crime. Our attorneys understand that internal investigations can, and often do, create tension between board members, management, audit firms, and government regulators.  Companies and their principals turn to Thompson & Knight because of our broad-based experience with each of these groups and our ability to address and solve the difficult issues that companies experience when investigated. Our attorneys have been involved in a number of Sarbanes-Oxley internal investigations, including investigations related to allegations of bribery and corruption, healthcare fraud, securities fraud, insurance fraud, Foreign Corrupt Practices Act issues, insider trading, U.S. Customs enforcement, and self-dealing. We also have experience creating client-specific compliance and training programs to help mitigate government investigation issues.

Our attorneys include former federal and state prosecutors who have acquired extensive practical experience in assertively representing individuals and companies during investigations and trials. Our practice includes a former Independent Counsel for the Whitewater investigation, a former U.S. Attorney for the Northern District of Texas, former Assistant U.S. Attorneys for the Southern and Eastern Districts of New York, former IRS and DOJ attorneys with experience in civil actions brought by the government in response to certain white collar crime allegations, and more.  They regularly defend companies, officers, and directors in formal and informal civil and criminal proceedings before the Securities and Exchange Commission; in matters involving the U.S. Department of Justice, the Federal Trade Commission, the Commodities and Futures Trading Commission, the Internal Revenue Service, the Federal Bureau of Investigation, and the antitrust enforcement divisions of several states; as well as in industry self-regulatory groups such as the New York Stock Exchange (NYSE) and the Financial Industry Regulatory Authority (FINRA).

Our attorneys have been recognized and honored among their peers for their abilities and dedication. We are proud that Thompson & Knight received a top national ranking for Securities Litigation in the 2018 edition of “Best Law Firms,” the preeminent listing of the nation's top legal practices from U.S. News - Best Lawyers®
